Labor and Employment Law

  • Defend employment discrimination litigation before federal and state courts from pleadings through trial and appeal, including claims for sexual harassment; race, disability, gender and age discrimination; retaliation; wrongful discharge; breach of contract; and whistleblowing.
  • Counsel and represent  management before federal, state and local administrative agencies on issues arising under Title VII, ADEA, FMLA, FLSA, WARN, ADA, NLRA, RLA, ERISA, and state and local laws, including plant closings, reductions in force, wage and hour investigations, and pension and welfare fund issues.
  • Draft, negotiate and review high level executive employment contracts.
  •  Draft, negotiate and review non-compete and restrictive covenant agreements.
  • Litigate emergent applications for enforcement of non-compete and restrictive covenant agreements, including allegations of misappropriation of trade secrets through electronic media.
  • Develop and deliver custom tailored employee-training seminars in areas such as sexual harassment, work place violence, and union avoidance.
  • Review and drafting of employee handbooks and personnel policies.
  • Provide training on harassment, discrimination, and retaliation prevention for employees and supervisors to keep your business in compliance under federal, state, and local laws, including mandated employee training required under New York law.
  • Provide training on procedures for your company to conduct impartial internal investigations, such as: policies on witness interviews; how to conclude an investigation; the issuance of a final report; how to retain documents, notes and evidence; and how to assess when to retain an outside investigator.
  • Condcut impartial independent workplace investigations to respond to employee complaints.
  • Representation at employment and labor arbitrations, including FINRA and AAA.

COMMERCIAL LITIGATION

Engage in all facets of Commercial Litigation that affect our clients’ businesses before the federal and state trial and appellate courts in New York and New Jersey to serve our clients’ particular business problems. Illustrative examples of this are ground breaking litigation brought under the Federal Computer Fraud and Abuse Act to protect our client from illegal intrusion of its secure internet site by a competitor, as well as defending insurance brokers and agents against broker malpractice claims.

 


GENERAL COUNSEL

As a natural complement to our Labor and Employment practice, we also act as an “outside general counsel” to our clients in areas such as:

  • negotiating and drafting licensing, marketing, employment and independent contractor agreements;
  • advising on how to do business with bankrupt vendors and suppliers;
  • protecting and defending intellectual property rights; and
  • selling, buying and forming private businesses.
